ARBITRATION

Arbitration is an alternative dispute resolution method that allows disputes between the parties to be resolved through arbitrators instead of state courts. Istanbul Arbitration Center (ISTAC) contributes to the resolution of disputes between commercial actors both in Turkey and abroad by providing a fast, flexible and cost-effective trial service.

1. Why Arbitration? Arbitration allows disputes to be resolved more quickly and effectively. Arbitrator decisions are binding and enforceable, just like court decisions. The arbitration process can be flexibly tailored to the needs of the parties and is generally less costly than in state courts.

2. Within the scope of ISTAC Arbitration Rules , Expedited Arbitration is a fast and simplified trial method foreseen for disputes whose amount does not exceed 5,000,000 TL. This process, carried out by a sole arbitrator, is usually concluded within 3 months and the arbitral decisions are immediately enforceable.

4. The Emergency Arbitrator ensures that the parties can take emergency measures before starting the arbitration process. This mechanism provides an effective solution, especially in cases where disputes need to be resolved quickly.

5. Arbitration is conducted by arbitrators who specialize in various fields such as commercial, construction, finance and corporate law. This ensures that the parties' disputes are resolved by experts in the field.
